Mi participación en #NETmundial

Les comparto mi breve participación en el evento de #NETmundial que se llevó a cabo en Sao Paulo los días 23 y 24 de abril de 2014. Desafortunadamente no pude leer el texto completo porque de dos minutos que se tenían contemplados originalmente para cada participante, se redujo a tan sólo 30 segundos:

My name is Leon Felipe Sanchez a member of civil society speaking on my own personal capacity. I would like to comment on paragraphs 13 and 22.

With regards to paragraph 13 which currently reads as follows:


The ability to innovate and create has been at the heart of the remarkable growth of the Internet and it has brought great value to the global society. For the preservation of its dynamism, Internet governance must continue to allow permissionless innovation through an enabling Internet environment.

I believe that paragraph 13 should be drafted within the frame of article 27 of the UDHR because we need to consider that in the internet users are creators and creators are also users. Therefore, appropriate mechanisms to address the rights of both stakeholder groups should be considered in order to foster an environment in which balance between the rights of the first and the latter is achieved, proper safe harbors that limit liability for internet intermediaries are provided with recognition of free flow of information, within the rule of law, as a driver for innovation and empowerment of the digital economy.

With regards to paragraph 22 that currently reads as follows:

Enabling meaningful participation: Anyone affected by an Internet governance process should be able to participate in that process. Particularly, Internet governance institutions and processes should support capacity building for newcomers, especially stakeholders from developing countries and underrepresented groups.

I would like to add to the text a call upon governments in order to have them open all multilateral negotiations, whether commercial or not, that incide in public policy that impacts the internet so that there’s the chance to receive wide input from all stakeholders on an equal footing environment because governments cannot continue to create public policy without considering and keeping public interest in mind.
